2. User Eligibility

To use our services, you must:

  • Be at least 18 years of age.

  • Be legally capable of entering into binding contracts.

  • Ensure all information provided to us is accurate and up to date.

3. Scope of Work

  • Project deliverables, timelines, and goals will be defined in a separate written agreement or proposal.

  • Any changes to the scope of work will be discussed and agreed upon in writing.

  • Work outside the agreed scope may incur additional charges.

4. Client Responsibilities

Clients are expected to:

  • Provide timely feedback, approvals, and required access (e.g., website logins, ad account credentials, branding assets).

  • Ensure that all materials shared (images, copy, videos) are legally owned and free from third-party infringement.

  • Cooperate actively to avoid delays.

5. Payment Terms

  • Initial Deposit: 50% of the total project fee is due upfront.

  • Final Payment: 50% upon project completion or as per a mutually agreed milestone/retainer plan.

  • Payments are accepted via bank transfer, credit/debit cards, or other approved payment methods.

  • Late payments may result in paused services or late fee charges.

6. Confidentiality

  • Both parties agree to maintain the confidentiality of all non-public information shared during the project.

  • Optimosis will never share, publish, or misuse any client data or credentials.

7. Intellectual Property

  • Upon full payment, all custom deliverables (e.g., website design, content, creatives) will become the client’s property.

  • Third-party assets such as plugins, stock media, or software remain subject to their respective licenses.

  • Optimosis reserves the right to showcase completed work in our portfolio unless otherwise requested in writing.

8. Limitation of Liability

  • Optimosis shall not be held liable for indirect, incidental, or consequential damages resulting from service use.

  • While we follow best practices, no guarantees are made for specific outcomes (e.g., rankings or revenue increases).

9. Revisions and Edits

  • All revision allowances will be defined in the project agreement.

  • Additional edits outside the included revision scope will be billed separately.

10. Cancellation and Termination

  • Either party may terminate a project or service with a 14-day written notice.

  • All work completed up to the termination date will be invoiced and must be paid.

  • No refunds are issued for completed or partially executed work.

11. Third-Party Tools & Platforms

  • We may use platforms such as Google Ads, Meta Ads Manager, WordPress, or plugins for delivering services.

  • Optimosis is not responsible for changes, errors, or downtime caused by these third-party services.

12. Legal Compliance

  • Both parties agree to comply with all relevant laws and regulations, including but not limited to data protection, advertising standards, and copyright laws.

13. Dispute Resolution

  • In case of disputes, both parties agree to first attempt resolution amicably through direct communication.

  • If unresolved, the dispute may be escalated to arbitration or legal proceedings in accordance with local jurisdiction.

14. Updates to These Terms

  • Optimosis reserves the right to amend these Terms and Conditions at any time.

  • Any significant updates will be communicated via email or posted on our website.
